If they live in Europe, then no (Munich Convention, point 52.5)
If they live in US, then yes

I would suggest OGG VORBIS (visit http://www.xiph.org/ogg/ for details)
that is patentless, LGPL/GPL etc.

When 1.12 will be out OGG VORBIS will be stable enough.
