You need to ask him for permission to use it under the GPL or public
domain. Him saying that it must be public domain in the US is not good
enough, even if it was correct, since we are not all USians.

(PS I doubt that his reading of copyright law is correct here. While you
may not be able to copyright a flag as such, the rendition of a flag as an
image file is surely under copyright.)
