Hmm, that's strange, because w/ the same setup, my 'play' would wait until
the mp3 was done, then execute...  how it used to work was that play would
just exit saying "device busy" which is what i'd prefer...  if i'm
listening to an mp3 (on /dev/dsp0) and trying to play on /dev/dsp0,
whichever started last should give an error about the device being
locked...

what card are you using?
