In the savegame and screenshot (attached separately) the following happened:

- I conquered the enemy city of Zephath.
- The enemy had civil war; the Arab nation was created.
- I moved a bomber down to attack Beit-Horon (not even noticing the 
civil war).
- The bomber couldn't attack; "declare war first".
- I decided to try to meet to make peace.  But I have no contact.
- So I moved an alpine troops down to make contact (I guessed the bomber 
didn't do it).
- But now I still have no contact.

In this game I have Marco Polo's Embassy but it's obsolete.

This is under the effects patch.  This may matter; I'm not sure.
