Not really a bug... it is a known oddity of the current rules.

Yes, it is a bit ... hillarious. We've had a loooong discussion about this
in the past (and a proposed solution: layers), and it did not come to a
conclusion. Feel free to google up the discussion in the mailing list
archives (or in RT), and rekindle the debate.
