Short Form: The California Court of Appeal ruled that DeCSS is speech, and,
as such, is protected by the First Amendment. Any web site publishing it is
also protected by the First Amendment. 2600.com is also involved in an
infringement case in New York for publishing the same code. While the
California case doesn't have any direct bearing on the New York case (the
2600.com case is in federal court for copyright infringement, the case
against Andrew Bunner was a state trade secret violation case), it does set
a precedent to which the Electronic Frontier Foundation can refer and argue
towards.
